Top Saddlery seat defect?

Let us know how your credit card company views this issue (and which card it is). I would very much like a TS seat, but I'm not willing to jump through any hoops if the seat arrives defective. American Express has backed me up when I have had little customer service issues in the past. I was thinking about rolling the dice (with the backing of AMEX or Visa), but it'd be good to know whether that's really a backup or not.

Will do, the dispute is in. I dont want a free seat, i just want it fixed which i think is fair. I mean TS didn't even offer to pay shipping for at least ONE WAY. Talk about not working with the customer. :Flip:

I would have 0 problems doing a charge back on a company like this! It's either hit or mis with theme. It seems the mis is more common that the hit lately.

At this point I have been credited by my CC company for the full charge. I dont expect this to be the end of it at this point. I will post more info as it comes. Tomorrow I go to a local auto upholstery shop which does motorcycle seats as well to see what it would cost to fix the seat. Just an estimate since I dont want to do anything until all is said and done.

You do know that on a charge-back, the goods purchased are not yours and that it is the responsibility of Top Saddlery to pick them up from you (pre-paid shipping label) correct? :spank: :D

I understand that. As a matter of fact I haven't even been using the seat as its sitting on my table downstairs. Such a shame as its a beautiful seat. All i wanted was that crappy company to do right by me. Why couldn't they at least offer to pay for shipping ONE way? Nope, not even offered. Plus as another member pointed out he received a broken seat pan in return. I'm paranoid about something like that happening in my case. I'll repeat what I said earlier though. I want to keep the seat for sure, but i want them to bear the cost of shipping as they told me i need to. That's not good business IMO.

The reason I pointed the fact that it isn't yours out is because you stated you intended to take the seat out and have it worked on. Not even an estimate would do you any good. Once that seat is picked up by TS, you will not see it again. You now will have to place a NEW order to get another seat from them. This seat, other than them retrieving it, is "said and done." ;)

^^^ :rof:

I just don't want him to waste any money on it only to discover that it will be returned. There's always a chance that TS will just take the loss and say screw it too. ;)

Trust me, im not getting ANYTHING worked on until i know for sure all is said and done. and yeah, i would love for them to say screw it, but like i said, im not looking for a freebee, i just want them to stand by their product and not at the expense of the customer.

As indicated on the private answer we sent you today, we post on the forum the full text of this answer :

Dear Sir,

We cannot accept your disparaging remarks about the alleged dishonesty on our part, let alone hear that there might be many unhappy clients who have been complaining about our seats on various motorcycle forums.

On the contrary, we have distributed thousands of motorcycle seats all over the world, including the United States, for more than 15 years now, and we can pride ourselves on the many praises that we have received about the quality of our products and services.

As in any activity, especially in manufacturing, unexpected problems do sometimes arise on certain rare occasions, in which case we do everything we can to solve the problem and satisfy our clients. Nevertheless, this should not be construed as an open door to all kinds of abuse.

In the case of your seat, let us reiterate that we have serious reasons to believe that such a tear in the front part of the seat could have occurred spontaneously. We know our products well, especially the SEL003 material of which this part of your seat is made, thanks to more than 15 years' worth of hindsight. Such a tear could only have been caused by improper use of the seat, e.g. it having been dropped by just a few tens of cm onto a hard floor, or from friction against an abrasive surface such as the rubbing of the seat when placed in a vertical position on a concrete floor. Besides, the fact that you waited more than 3 weeks after receipt of the seat before informing us of the damage (notification which, incidentally, was given after the legal 7-day cooling-off period with respect to the legislation on online sales) is not to your credit.

Being fully aware of the significant amount involved in the purchase of a seat, which you so kindly pointed out, and given that there were grounds for doubt ("your word against mine"), especially between two parties who are separated by an ocean - the dematerialization of online transactions does not ONLY have advantages in this respect - we immediately proposed, right from the very first time you got in touch with us, to do our part by offering to repair the reported damage at our expense, and asked you to do yours by paying the shipping charges to and from our workshop. And yet you express your fierce dissatisfaction by threatening to make defamatory remarks to anyone who would care to listen ... For someone who wishes to give us a lesson on loyalty, you should know that blackmail is hardly an elegant way of going about this, and thus we could very well decide to leave things at that.

However, we are willing to make one last reconciliation effort by suggesting that you pay the outgoing shipping charges (USA to France), while we will bear the costs of repair and shipping back to the USA. This is the very last and best proposal that we can make given the dubious conditions under which the damage was reported.

Your insults regarding our honesty and your defamation threats are certainly no way to behave and we will, at the same time as this personal message is being addressed to you, make known our position on this matter by posting this message in its entirety on the FZ6-International forum where you have been behaving inapproriately by spreading rumors about our alleged "dishonesty" and "appalling service quality".

Both versions of the story will thus be heard and the forum users - including those who have expressed their complete satisfaction with our products - will finally be able to form their own opinion once and for all.

Best regards,

Top Sellerie

Objet : Re: Problem with seat recently ordered

There is a reason alot of people have had zero luck on the yamaha forums when dealing with your company. I will never purchase a single thing from your company again. To have such horrible quality control and customer support for a brand new seat is a complete outrage. Someone spends their hard earned dollars and ALOT of dollars only to be screwed over royally. For anyone on the yamaha forums and riding friends who are inquiring on buying a seat from Top Sellerie I will absoulutely do my hardest to persuade them to look elsewhere because there is no support or loyalty to be found.

is ok people, i am here to help

"that such a tear in the front part of the seat could have occurred spontaneously"

If TS knows their seat material can 'spontaneously' fail........ why are they using that material? 'Spontaneous' combustion happens to Pintos, and drummers.... and laptop batteries.

Sorry... an error with the translation ; the right sentence should have been "that such a tear in the front part of the seat could NOT have occurred spontaneously", of course.
