Hit and run, a Moving violation with evidence. Another option is to talk to the family and settle out of court. He might want to keep his license and not escalate this. Sounds like he may skate as is. However, the opinion of one officer should not be the gating factor here.

I'd love to talk to him calmly, but there's no guarantee he won't be upset and he lives way to close to me. I've talked to adjuster and was told that as is, it's a no fault accident, meaning I have to shell out the $500.

The alternative is to wait for police report and see exactly what it says. If there is enough info in there, my company *may* be able to go after his company. So that's what I'll do.. wait for report.

sucks but what can you do.. i agree your just out coin.. no one hurt and its just a car (not the bike mind you).. still sucks... hopefully the family will get involved even just from the cop stopping by and inquiring about him hitting some "trash cans".. its sad when you get to the point that you shouldn't be driving.. was tough when we took my grandma's license away but then you just remind them that they are getting chauffeured around... still sucks about the car... hopefully insurance will cut you a break :thumbup:

Unfortunately part of the risk for parking a car or bike on the streets. I believe your insurance rate might even be higher if they are not stored in a garage. This thread is giving me the chills, my Dad is almost 90 and still driving. He has been diagnosed with dementia. He almost side swiped another car by turning wide, failing to maintain his lane while conducting a left hand turn that had two lanes while I was visiting over xmas.

Even if the cops can't do anything. I think it does good to inform him, his family and his insurance.

Screw that old guy. He shouldn't have a license!!! And I am sure he has been told not to drive. Let me explain my hate towards elderly mental defecient folks.

There was an elderly man here who was told one day to NOT drive by his doctor. Upon leavin, he backed into someone's car.

This is where I lose it.

He still continued to drive, one day on te highway he crossed the center line. Hitting another car head on. Injuring a little boy, his mother, and killing a 5 year old girl. As a father, I wouldn't know what to do. He has not served a prison sentence.

Make that stupid old bastard pay! His family needs to be notified, they obviously know, if not I would do my best to make them pay as well. I hope to god he drives off the road into a tree killing himself before he hurts someone else.

Sorry. But atleast you or no one else. (I could care less for him, he might as well be a drunk driver, and his wife the enabler for letting him have the keys.) was hurt.

If you do file a claim against his insurance it will or should throw a flag to them. Also it is noted by you having filed a report that he has had an accident which would cause problems if he has another accident. Not comforting but think you did the right thing pursuing it. Totally agree that he should be out of the drivers seat but sometimes that is hard to do and as a couple of folks have mentioned some drive anyway.

We had a major snowstorm this week which shut everything down - 1 inch of snow (OK you can laugh now). Talked to one person who parked their S class a couple of hundred feet from their driveway and not in the roadway. Oops, crash bam boom as people were bowling with 4 wheel drive vehicles including a 535XI BMW. Amazing! Recipe: 1 inch of snow + steep incline + southern drivers = lots of smashed cars. :-( Made for some good photos though.

With no fault insurance your company always pays to fix your car, but they may go after the other driver's insurance company to recoup some of the damages and possibly your deductible. You may want to get an estimate before filing any claim because your rates may increase.
I fear as our population ages we will see more poor drivers on the road, not that there aren't enough now. Making the family aware and filing a report is the right thing to do. Maybe they will be more restrictive with his driving.

Yeah sometimes a small amount of snow on the roadway is much worse because the tires will actually track better in deeper snow so you can at least steer around a stopped object. And experience is also a big factor!

It's only a hit n run if there are witnesses (or video, I guess). Driver is getting away without any repercussions in this case.

Some residential streets are not state maintained. If that is the case then the accident occurred on private property (like getting hit in a parking lot) and 9/10 times that is a no-fault accident unless you have a witness and then your insurance company can go after theirs for the damages.

I once got a ticket for obstructing city's snow plowing efforts on my street.. which tells me the town does not classify my street as private property.

Oh and my other car was hit several years ago in on the same street (30 feet from where this one got hit) and there was a witness. Driver was found to be at fault and I did not need to pay a dime.

So I wonder if they could even use surveillance camera footage as evidence in something like this without taking it to court? Can you just show the officer the video and he can write it in his report?

Our laws are written in favor of criminals, tells me a lot about the people who write them.

If the cop literally put 2-2 together with the paint and pieces and Still you need a witness? That makes my soul hurt a little. By golly if mr. Senator had this happen to him it would turn out different. But then again. He has 500$ that's pocket change.
