FE's! Why are they illegal?

F*** - anti-hoon legislation? What's that all about? I'd like to think the guy maybe is leaving out a little of his story, to make people sympathise more with him, but there is a good chance he's 100% dinky di!

Have heard of similar stories re Anti Hoon laws in South Australia...

It seems, if the cops catch you doing wheelies, and stoppies, etc, they can take your bike...but it seems they may be able to stretch those laws to ADR's, if this story is correct...

And if that is the case, surely, it cant be that the Crown can take your bike, just because you refuse to put a rear fender on the bike...

I would say, without knowing stuff all about this story, that there must be more to the story...

If it is true, some of us need to be aware of these anti-hoon laws, and whether we are at danger of being targeted by them...and not for doing stoppies either!

OK , there is some major 'dressing up' of this story to as Kaz said , Gain Sympathy..... I've just finished reading the QLD Anti-Hooning laws (do you know how mind numbing that is) LOL & it states that for a bike to be forfeited to the crown there must be 4 offences in a 6 month period....

1st , he will be fined for the said offence , no impoundment...
2nd , he must be fined for the same offence within 1 month of the original , bike may be impounded for 48 hours but this is police disscretion...
3rd , he must be fined within 4 months of the original offence where upon he is suspended from driving , his bike is automatically impounded for 48 hours within which time the police have the option to apply for a 3 month impoundment being the length of licence suspension...
4th , he must be fined within 6 months of the original offence and therefor gain having his licence suspended he will the & only then surender his bike to the crown :eek:..... Thank god thats over , i have a headache :D

Insanity. Yet rewind the clocks even 5 years and it wasn't anywhere near this harsh, what's with that? You guys hear what Mark Webber said about our Nanny State in Australia? When will it end?

I'm wondering if this crazy ADR eminated from some outrageous litigation story back in the day, resulting in a knee-jerk ruling about wheel coverage? There's got to be some origination, as you wouldn't just decide that it would simply be safer if the rear wheel was more covered than not.....

I reckon it may be a hangover from the 40's, 50's, & 60's, when just about all bikes had massive rear fender's, that covered the whole wheel...i just reckon it has been conveniently left alone, and since exploited more since modern bike design has evolved recently, with more open, minimal rear end's, where a rear fender looks ridiculous...

If some of you people want me to have an opinion, please pm me with the section of the act (state etc) that the offence was concerned with.
Tell me what was on your fine notice.

I can then look at precedent and cases where we have some more information regarding the exact nature of the offence.
Personally, I like the rear fender however I believe it must be replaced if certain exhaust systems are fitted?

ok, I spend $6,500 pa on subscription to a legal search engine for lawyers that accesses a lot of information (case law, law reports, journals, international law and legislation, statutory interpretation etc), you won't get much specific information from your google searches.
Forget about 'The castle' there is no vibe here, just the legislation dealing with the motorcycle and it's rider.
Remember the no helmet laws protests of the 80's, where did that get us?
I have heard in 2 years we may all be wearing fluro vests?

Ok, here are my observations:
People have gone out and bought aftermarket exhaust systems and fitted them with a fender eliminator as part of the modification Key word, modification.

The Fender Eliminator has several modifications attached to it.
1. It changes the mounting of the number plate and number plate light.
2. It alters the original indicators position and style.

Key words, Mounting change and indicator position and style.

The fact that the enforcers of the law read motorcycle forums and motorcycle magazines has drawn their attention to these modifications, mounting changes and positions. They believe they have breached the original compliance the motorcycle received when it was registered in the first instance.
How do they do this so easily?
Ok, any police officer that books a motorcycle for registration or licence issues always uses the number plate as their first port of call when they radio in your details. As motorcycles only have one number plate, guess where the officer looks when he first sees a motorcycle?
It is a double whammy my friends.
If you have a noticeable FE, they probably pull you over before they check your details, I think there are 18,000 FZ6's in Australia.

So, rather than petition parliament or write to our local member or have a bike rally or such, lets talk to a motorcycle modification specialist.
I deal with several vehicle modification specialists in law and they always are required to get engineers reports, weigh the vehicle etc before it gets roadworthied after a modification. Now take my 2005 Coachman Mirada Motorhome that I bought out from the states and changed over to right hand drive................ surely a FE modification could be done quicker and cheaper!

It is my early opinion that if one was to have the modification stamped on their compliance plate, police would soon tire of pulling over bikes to fine them for have a FE that was in reality legal. A nice word that, LEGAL.

I await your further instructions my friends.
Don't get angry.
Take action and get even.
There must be some of these FE's that will pass compliance.

I,ve been looking on bike dealers sites and they are selling used bikes ,registered with fe's on them. Surely they would have to comply if it is a legal issue?

I've often thought this myself because they supposedly do 'Roadies" on all bikes..... My mate bought one that the had to get registered for him & they got it through inspection with an FE fitted :confused: Go figure...
 
Can't see that any FE will be legal. I have stock indicators, and they are the required distance apart. The plastic mud flap is no longer there, and part of the ADR states, that this hunk of garbage must come down to 45 degrees from the rear axle with 45 kg in the saddle. So even with all the reflectors etc. in place the ADR's still say it is illegal. May be able to get a dispensation through the engineering route. I'm not sure.

As for getting the ADR's changed. The link that Kazza posted ,has instructions on how to apply to get the ADR reviewed using the appropriate form.

LMFAO......Stuffed if I could find the appropriate form. Somewhere behind locked doors in a cellar somewhere?

Lol! Yes, it's a bit like that! Have not got round to doing much research lately...been busy with lots of other important stuff...like detailing my bike, and making a "new" "Rear Fender"! :D
 
If I lived in Australia, I'd probably be salty.

sorry man, hopefully Australia is different than america and you can change stupid laws and get that fixed up.
