I think the key is irrelevant as long as the bike was on your property. How many of you leave your keys on your bike or car in the garage. So it wasn't in the garage, but it was still on the property. Differen't story if it was on a public street.

I agree with VEGASRIDER. Even if the key was in the bike it was on your property and therefore the insurance company will still see it as theft from a private residence. I always leave the key in my bike in my garage. If I left the garage door open and someone came in and stole my bike, it would be the same situation that you are in right now.

This really sucks and I understand your frustration 1st hand as I had a Jeep Rubicon stolen a few years back.

I don't see you needing to lie about the key and if it were the case I still would not condone illicit advice to others on this forum.

Forgetting your keys should not make you less payable. Keys in an ignition should not be a legal issue because police use keys in a vehicle as a ploy to catch criminals. Do their cases get tossed because the keys were left in the ignition? If you saw keys in an ignition would that mean the owner has given you permission to take the vehicle?

Fact is people forget their keys everyday. Yes they're easier to drive away but that in no way makes your vehicle irresistible making it your fault.

It only takes a few seconds with out the keys.....

Too bad your not in AZ, I got some street connections that woudl probably have your bike found in about a day, and ya never know when somebody might disappear in the desert.

Riding away with a helmet seems like this was gonna happen one way or another. Thankfully no one was harmed. Would you be more pissed if it toppled?

It sucks and I can relate; I got my first bike back in crate as there was no insurance on it. It was cut and sawed jumped and bashed.

Sorry to hear, that is so bad. Watched a couple of guys seal my father-in-laws walled in the Paris subway. Bad part is I didn't know what was going on soon enough or could have stopped it. There are times you really want Dirty Harry...

As other have said deliberately misleading an insurance company is not a good thing to do, fraud could cost you more than the bike is worth. Sounds like you simple forgot to take the key out not a regular practice. Probably a crime of opportunity - someone noticed the key and then came back to get it. A little unusual I would think, don't have stats but think 6 in the morning is a less likely time for theft. More is stolen late at night.

I don't think anyone here ever suggested misleading the insurance company. If they don't bother to investigate the full nature, then a person is not obliged to provide that info.

I hope you get your bike back or at least get something just as awesome.

I agree though, it's BS that you can't pop someone who breaks into your house and steals from you. I got scammed for $800 a few weeks ago and I'm pissed enough to beat the guy senseless if I ever find him. Can't imagine how it feels to have a bike stolen.

I left it overnight with the keys at a campsite once. just lucky that no one noticed. some people just takes the opportunity when it's there.

Murder isn't really the word, suffer is more like it. Prior service combat medic in me knows what would make the paramedics on scene blush...

But I digress this is hypothetical and would never happen...

In some places in the world that's still called justice. Maybe it's because the ghost of the wild west influences us out here but a man would be hung if he got caught stealing a horse in the good ol' days. And if he got caught stealing from you directly I think nobody would bat an eye at if you shot him on the spot.

I honestly think people would consider something other than thievery if they knew their life was on the line. Honestly I think the white collar criminals like Bernie Maddoff and other Ponzi schemers should be executed. They stole these peoples ability to survive, so their survivability should be taken from them. There is a guy from AZ that got people to invest 500 million in his bogus company and fled to portugal. Becuase it is not a capital offense then there is no extradition and he has been living like a king ever since.

Thus if the qualifying conditions to ending another humans life were changed to make it the lawful killing of these criminals then it would no longer be murdered.

I think justice is due, maybe the thief being caught made to pay for the bike or maybe double the price then some prison time. But that probably won't happen.

So insurance will give you a check, you will get a new bike probably something better, that will be just as fun to ride or maybe even more fun. And in the long run you become a better person.

you left the keys in the ignition??? now i completely agree that you"should" be able to leave your doors unlocked and all that good wholesome warm feelings, but really.. have you never had stuff stolen? if you were in the military, don't they beat into you to "make sure your gear is secure"??? but enough of that..

yea that sucks that they stole it and yea you should have to go serve some time in jail.. hopefully they find your bike and just get it back to you...either that or have the insurance company pay you and get a new bike.

as for all the talk of fraud.. its not fraud (the whole family is in insurance).. it would be no different if a thief drove up with a truck and a friend and put the bike in the back.. but next time, i wouldn't leave the key in the ignition..
