Yes it can be mounted with a fender eliminator installed, as it does not need any of that hardware.
And as long as your aftermarket exhaust is not obscenely wide, it should fit just fine. If you look closely at the second picture, you can see the mounting bar bending down from the mounting...

I get a vibration/buzzing consistently at 7k rpm, and have found the cause to be where that curved piece of the headlight bracket tucks under the triple tree (riders right side) buzzing around. Don't know if that's the cause for you, just thought I'd throw that out there as a possibility.

Option #2 with the double lines from the master cylinder is what the mechanics at my local, and very reputable, dealership recommended. So that's what I opted for and the result over stock rubber lines is very improved and noticeable right away.
Another 2008 here as well. Have 2wheels levers and just had Galfers stainless steel lines installed and I feel a world of difference in my brakes front and rear. Quite happy with them, would make the switch again.

My soft saddle bags never had a problem with the exhaust melting the material. That said, when I had a lot of weight in them they sagged inward to the point that they rubbed on the rear tire. So I would keep an eye out for that as well.

Here in Ohio, it is neither legal nor illegal specifically. No statutes against it, but one jerk cop could easily write you a ticket if he thinks you are riding recklessly by lane splitting. Haven't tried it yet, going to give it a shot when the weather thaws in March.
Only negative thing I could say about the kit, is the quality of the large mounting bolts included. I don't know what the deal was, thread size just barely too large, or inferior quality of metal, or what. But the one bolt bent as I was threading it into the frame, which only allowed it to be...
