a good friend of mine had the same thing happen to him wedneday, except he was on a pedal bike (he had just qualified to bike in the empire state games). He's not nearly as lucky as you were, as he broke 3 vertabrae, and is lucky to be walking.

Glad you're alright man, and after 3 serious wrecks in so little time. The bike, while a work of art, really, is just a machine that can be replaced, but walking away is something even more amazing at times.

Good luck with the totalling, and I can't wait to see v4.0, or what becomes of an 848 speed triple, or whatever follows.

I think I mentioned this already somewhere in this thread, but my insurance comp only knows about my first totaled FZ, and it went up $5 a month for that... 2nd accident the bike and I were almost 100% fine, so no insurance claim involved, and I don`t think I`ll be held liable in any way in this accident, so my insurance shouldn`t go up... let`s see...

I had a lady try to do something simular to yours to me. I actually stopped in the road. She flipped me off and got mad because I didnt run into her. What can you do? I just wasnt going till she went by. We all make decisions everyday. It happened. Your ok, you will get a new bike and ride on.
 
Judo... OOOOOS. Shodan? Tokui Waza? I also have about 10 yrs of Judo experience. Planning on going back as soon as I heal my hip. For now, I'll stick with the visits to a chiropractor and an accupuncturist.

In France, we just call it Judo lol...

Going to see a Chiropractor tomorrow night...
 
Can you make sure you tell your lawyer that not only did the driver inflict pain and suffering which you would like to be compensated for, but also to include all of us members here on this forum as well as we all agreed that your bike was freaking awsome, and your bike was not just representing you, but all the 3000 plus members here on this forum at Laguna Seca next week as the top 100 Yamaha bikes. Therefore we as members are suffering through the pain of your loss and wish to be compensated as well. Would a petition help?

I always loved your posts, but that was just the best :thumbup::rockon: and I will ask for a new helmet at least... my insurance in France would automatically give you the $$ for a new helmet ;)
 
I don`t know about whether or not she was ticketed... I was on my back and then transported to the hospital... I don`t know wth happened there... getting a copy of the report may take up to 10days :(

I won`t settle for anything less than the $6k for what I think the bike was worth, + all medical expenses.

I was told by a lawyer that it would help your case significantly if the driver was cited by the police which proves that she was 100% at fault not yielding to the right of way.

What about the pain and suffering? Heck, she was driving a Mercedes, she or her insurance should take care of you handsomely.

Currently waiting for the Police report... I literally have no information at all about what happened at the scene between the driver and police... no clue... there were a bunch of witnesses around though, so I am hoping it`ll be a straight forward case... of of the witness stopped by to talk to me while I was laying on my back and told me she "saw everything"... I did ask that she stick around if possible and she said "of course"... no idea if she talked to the police of not... she did mention she and her husband were riders too... it felt good to hear for some reason...

ya it is comforting to know someone is there that is on your side and shares who you are. almost like family. who you are and who they are overlap a little bit. trusted allies in a sea of sworn enemies.
 
So I just got the Police report...

Basically it confirms my version... the Mercedes driver got a ticket at the scene (19yo asian woman), for being in "violation of CVC 21804 (a), failure to yield while entering a roadway from private property".... she is supposed to appear in court on 8-8-08.

The witness (woman) that stopped at the scene and came to talk to me while I was laying on the ground stayed on the scene as well, and confirmed my version to the cops, so that helps a lot... "She was travelling eastbound [on the same street, opposite direction], and saw the Yamaha vehicle (me) approaching at about 40-45mph [...]. She stated that the Mercedes was driven out of the driveway on the north side of the street, with the driver attempting to make a left hand turn. She stated she believed the vehicle was possibly coming across even into her lane, at which time she began to brake to avoid a collision.
She stated she watched as the Mercedes was driven directly in front of the path of the Yamaha and watched as the Yamaha collided with the Mercedes, sending the rider (me) over the hood and roof of the Mercedes".

The Mercedes driver also stated to the cop that "she was pulling out of the private driveway attempting to make a left-hand turn onto the street. She stated she looked to her left to clear traffic and stated she saw no vehicles coming her direction and she began to make her left-hand turn across westbound lanes of traffic".

There were "39 feet of preimpact skids"...

I thought I landed 20 feet on the other side of the Mercedes, but the report states 30 feet.... I still can`t believe that after such a flight, I did not have a scratch on my body... GEAR FTMFW!

So that should be an easy one for the insurance companies :)

Now I have to decide whether to go claim my money (for the bike only, the rest will be handled by my lawyer) from the Mercedes driver's insurance company or mine... if I go through mine, I`ll get the money faster, but I`ll have to pay the $500 deductible until the other insurance reimburses me... I will also have to get the money for my helmet from the other insurance, as my insurance does not cover anything that is not mounted on the bike (bs if you ask me...). The thing is, you don`t know what both insurance companies will offer... so I might just contact both and have them tell give me the total amount before chosing... any of you guys have experience with that kinda stuff?

Anyway, I am pretty happy of the outcome so far...

Stay with Yamaha, if not a FZ6 then a FJR1300 :)

Good luck with the insurance, it sounds like everything is on your side so that's one consolation :thumbup:

Hope you get back on the road ASAP, preferably on a FZ6 of course can't wait to see V4.0 :rockon:
